Terms of service

These terms govern use of the Scanaria website and platform (the "Service") provided by Scanaria ("we", "us"). By creating an account or uploading a file you agree to them.

1. The Service

You upload point cloud files and panorama images. We process them into a virtual walkthrough that you can download as a folder and, if you choose, host on our platform at a link we provide.

2. Accounts

You must give accurate contact information and keep your sign-in method secure. You are responsible for activity under your account. You must be at least 18 and, if acting for a company, authorized to bind it.

3. Your content

You keep all rights to everything you upload. You confirm you have the right to upload it and to have it processed and shared through the Service, including any rights of property owners and people who appear in panoramas. You grant us only the license needed to store, process, display and deliver your content as you direct.

4. Ownership of output

The walkthrough we produce from your content, including the panoramas, processed point cloud and the viewer folder, is yours. You may copy it, archive it, give it to clients and host it anywhere. The viewer software inside the folder is licensed to you for use with your projects without limit of time; you may not resell it as a standalone product.

5. Pricing and payment

Your first project is free. After that, processing is billed as a monthly plan at the price shown on the Pricing page, covering unlimited projects while the plan is active; every finished folder can be downloaded during that time and kept afterwards. Hosting is optional and included in the two larger monthly plans, each up to a stated amount of storage, and can be stopped at any time. Prices are in USD and exclude taxes. Payment is handled by our payment processor.

6. Hosting and termination of hosting

A hosted tour stays live while hosting is paid. When hosting stops, the link stops working. The project remains downloadable for a grace period, after which it is removed. We do not keep your tours hostage: you can download the folder at any time while the project is hosted.

7. Acceptable use

Do not upload content you have no right to, content that is unlawful, or content that infringes privacy or intellectual property. Do not attempt to break, probe or overload the Service, or use it to build a competing processing service by bulk extraction. We may suspend accounts that breach these rules after notice where practical.

8. Processing results

Processing is automatic. Quality depends on the scan you upload: registration accuracy, imagery, coverage and lighting. Measurements in the viewer are taken from your scan data and are provided for reference; they are not a certified survey.

9. Availability

We aim to keep the Service available but do not promise uninterrupted operation. We may change features over time; we will not remove the ability to download your projects.

10. Warranty and liability

The Service is provided "as is". To the extent permitted by law we exclude implied warranties, and our total liability for any claim is limited to the amount you paid us for the project concerned in the twelve months before the claim. We are not liable for indirect or consequential loss.

11. Indemnity

You will defend and indemnify us against claims arising from content you upload or from your breach of these terms.

12. Changes

We may update these terms. Material changes take effect 30 days after we email account holders. Continued use after that is acceptance.

13. Governing law

These terms are governed by the laws of the State of New York, and disputes are heard in the courts of the State of New York.
